Conditions of Sale

(pursuant to Chapter I, Title 3, Part 3 of Legislative Decree 206/2005 as amended and supplemented)

1. Introduction and effectiveness of the General Terms and Conditions

These general terms and conditions of sale (hereinafter, the ‘General Terms and Conditions’) govern the purchase of products and services, made at a distance and made available, via the Internet, from the website www.bioreggiani.com (hereinafter, the ‘Site’) in compliance with the Italian regulations set forth in Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, the ‘Consumer Code’).

The consumer who accesses the Site to make purchases (hereinafter referred to as the ‘Customer’) is obliged, before sending the order, to carefully read these General Terms and Conditions that have been made available to him/her on the Site and that will be available for consultation at any time by the Customer also through the link contained in the confirmation email of each order to allow him/her to reproduce and memorise them.

2. Choosing and Ordering Products

The characteristics and prices of the various products on sale on the Site (hereinafter “Product” or “Products”) are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained in the Site. The Customer must add the Product to the “Cart” and, after having read the General Conditions and the Policy of Privacy and confirmed their acceptance, you will have to enter the shipping and possible invoicing data, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.

The contract stipulated between Caseificio BioReggiani and the Customer must be considered concluded with the acceptance of the order by Caseificio BioReggiani. This acceptance is communicated to the Customer through an order confirmation email containing a reference to these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the total price, including delivery costs.

Once the order has been received, Caseificio BioReggiani will check the availability of the stocks to process the order itself. In the event that one or more Products are not available, the Customer Service of Caseificio BioReggiani will promptly send communication via email to the Customer who, within the following 24 hours, will have the right to respond to confirm the shipment of any additional available Products or cancel it. In case of no response within this period, the order will be considered confirmed and the available Products will be sent for shipment. If only a few Products are not in stock, Caseificio BioReggiani will process the order with the available Products. In both cases, the amount relating to the missing Products will be reversed and refunded immediately depending on the payment method chosen.

To purchase Products, the Customer shall fill in and send the order form in electronic format, following the instructions on the Site. The Customer shall add the Product to the “Shopping Cart” and, after having read the General Conditions and Privacy Policy and confirmed their acceptance, shall enter the shipping and invoicing data, select the desired payment method and confirm the order.

3. Product Information

The information and characteristics relating to the Products are available, with the relevant Product codes, on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality but may differ in color and size. In the event of a difference between the image and the written product sheet, the description on the product sheet always prevails.

Shipments to Italy:

The entire shipping chain is entrusted to MBE, which will choose the courier that offers the best service based on the destination area;

the shipping cost is proportional to the weight ordered, the destination area and the type of shipping chosen. Standard with delivery in a maximum of 3/4 working days or Express guaranteed within 24 hours of shipping the goods.

Shipping to Europe:

The entire shipping chain is entrusted to MBE, which will choose the courier that offers the best service based on the destination area;

the shipping cost is proportional to the weight ordered, the destination area and the type of shipping chosen. Standard with delivery in a maximum of 5 working days or Express guaranteed within 24h/48h from shipment of the goods.

USA and non-EU shipments:

The entire shipping chain is entrusted to MBE, which will choose the courier that offers the best service based on the destination area;

the shipping cost is proportional to the weight ordered, the destination area and the type of shipping chosen. Standard with delivery in a maximum of 7 working days or Express guaranteed within 72 hours / 144 hours from shipment of the goods.

NB: CUSTOMS COSTS/TAXES OF THE NON-EU COUNTRY of DESTINATION ARE EXCLUDED IN THE TOTAL ORDER + SHIPPING.

5. Payment and invoicing methods

5.1 Payment Methods

The Customer may pay the price of the Products and the related delivery costs via PayPal, Stripe Cash on Delivery and bank transfer.

PayPal

Once the order has been confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his bank account or using a card, including a prepaid one, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions.

Paypal accepts the following credit cards: MasterCard, Maestro, Visa, Visa Electron, American Express, Aura and Discover.

This payment method is available only for shipments made to Italy. Payment will take place upon receipt of the Products and can be made exclusively in cash for orders up to €150.

Stripe

Thanks to Stripe’s Payments platform we accept credit cards, debit cards and popular payment methods around the world. Furthermore, we support international cards, currency conversion, 3D Secure authentication. Stripe Accepts all major debit and credit cards from customers in every country. Mastercard, Visa, Maestro, American Express.

5.2 Invoicing of Orders

If the purchase is made by a professional, an invoice will be issued. In this case the invoice will be sent via email to the address indicated. The professional is responsible for correctly entering the billing data.

6. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate field.

N.B. All purchases will be shipped via express courier from Monday to Wednesday, excluding holidays and national holidays in Italy. Orders received from Wednesday afternoon to Sunday will be shipped starting from Monday of the following week (except in exceptional cases). Why this choice? In order to guarantee and maintain the highest quality of the product during transport, thus avoiding possible stocks in the warehouse during weekends.

Caseificio BioReggiani is not responsible for delays that are not foreseeable or cannot be attributed to it.

In any case, except in cases of force majeure or unforeseeable circumstances, the ordered Products will be delivered within 7 (seven) working days for Italy and Europe starting from the day following the day on which Caseificio BioReggiani confirmed the order to Customer via specific order confirmation email.

For orders destined for the USA and other non-EU countries, delivery times are expected between 4 working days and 7 working days

We remind you that for non-EU countries there are customs duties, which vary depending on the country of destination. These costs are the responsibility of the recipient and are not included in the order total.

We therefore recommend checking the Customs costs before placing the Extra EU order. Caseificio Bio Reggiani is in no way responsible for any customs duties.

N.B. All purchases will be shipped by express courier from Monday to Wednesday, excluding public holidays and national holidays in Italy. Orders received from Wednesday Afternoon to Sunday will be shipped from Monday of the following week (except in exceptional cases). Why this choice? To be able to guarantee and maintain maximum product quality during transport, thus avoiding possible stocks in the warehouse during weekends.

Caseificio BioReggiani is not liable for unforeseeable delays or delays not attributable to it.

In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 7 (seven) working days from the day following the day in which Caseificio BioReggiani confirmed the order to the Customer by means of an order confirmation email.

7. Right of Withdrawal

The company recognizes the purchaser’s right of return provided by law; which applies exclusively in the case of purchases made by private customers. Pursuant to the aforementioned legislation, the customer has the right to withdraw from the purchase within 14 days of receiving the goods. To exercise this right you must send the Company a communication by registered mail addressed to:

Communication should be made in advance by email, as long as it is confirmed within the following 48 hours in the manner set out above. The right applies to goods purchased in their entirety; it is not possible to exercise the withdrawal only on a part of the product. The goods must be returned in their original packaging, intact and without tampering.

Shipping costs relating to the return are borne by the Customer by insured carriage paid. Cash on delivery or freight collect parcels will not be accepted. The integrity of the product and packaging to be returned is an essential condition for exercising the right of withdrawal. After receiving the disputed goods and verifying their state of conservation, Caseificio Bio Reggiani will reimburse the customer, within 14 days of receiving the communication, the entire amount of the order paid for the goods via bank transfer via the bank details (IBAN code ) of the Customer’s current account.

Once the communication has been received, the Customer Service of Caseificio BioReggiani will open a procedure for managing the return and communicate to the Customer the instructions on how to return the Products, which will take place via courier indicated by Caseificio BioReggiani itself.

The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore if the Product is made up of multiple components or parts it is not possible to exercise the withdrawal only on part of the purchased Product.

II. In the event of exercising the right of withdrawal, Caseificio BioReggiani will refund the customer the entire amount of the returned goods, within 14 days from the date on which the notice of withdrawal was received, without prejudice to Caseificio BioReggiani’s right to suspend payment of the refund until upon actual receipt of the goods. The refund will be made using the same payment method used by the Customer, unless the Customer has expressly requested a different method.

III. Also in order to guarantee free returns pursuant to article 8 below, the Products must be returned in the same box in which they were received.

IV. In addition to the cases indicated in the Introduction (customer who is not a consumer and/or who requests an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 Legislative Decree 21/2014:

order of Products made to measure or clearly personalized;

order of Products that are likely to deteriorate or expire rapidly;

order of sealed Products that are not suitable for return for hygienic or health protection reasons or which have been opened after delivery.

With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that “risk deteriorating or expiring rapidly” include all food products (including wines, spirits and drinks), as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for hygiene and customer protection reasons, the right of withdrawal is applicable only for Products purchased on the Site which can be returned to Caseificio BioReggiani and put back on the market without dangers to the health of consumers (such as kitchen utensils, etc.).

In cases where the right of withdrawal is excluded, Caseificio BioReggiani will return the purchased Products to the Customer, charging the shipping costs to the Customer.

We remind the customer that in the event that the sealed and packaged products present alterations or problems of any nature, it is necessary to promptly contact the Customer Service of the BioReggiani Caseificio to communicate the problem encountered at the email address [email protected] or by calling the number +39 328 4270908.

8. Free Returns in the Event of Exercise of the Right of Withdrawal

As a more favorable condition for the Customer, Caseificio BioReggiani fully bears the shipping costs for returning the Products in the event of exercising the right of withdrawal.

In order to benefit from this free shipping, the Customer who intends to exercise the right of withdrawal must follow the procedure indicated in the previous article 7 and wait to be contacted by Caseificio BioReggiani to arrange the return of the Products to the courier.

9. Warranty and Defects of conformity

In the event of lack of conformity of Products sold by Caseificio BioReggiani, the Customer must immediately contact Customer Service using the appropriate contact form accessible on the Site via the “Contacts” page.

The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. The Customer has the right, at his choice and provided that the type of Product allows it, to restore, without charge, the conformity of the Product through repair or replacement, or to an adequate reduction in the price or to the termination of the contract. The Customer loses these rights if he does not report the lack of conformity to Caseificio BioReggiani within two months from the date on which he discovered the defect, provided that it is not a Product which by its nature is perishable or subject to expiry in a shorter period, in which case the defect must be reported within this reduced period.

10. Errors and Limitations of Liability

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Caseificio BioReggiani cannot therefore be considered responsible, except in the case of willful misconduct or gross negligence.

Caseificio BioReggiani reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior communication, without prejudice to the Customer’s rights under these Conditions Generali and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance or evasion, even partial. , of an order.

Caseificio BioReggiani promotes the responsible consumption of alcohol and excludes any liability on its part, except for malice or gross negligence, in the case of purchases made by minors under 18 years of age.

11. Complaints

13. Applicable Law and Jurisdiction

The sales contract between the Customer and Caseificio BioReggiani is intended to be concluded in Italy and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders if the Customer is a consumer pursuant to the Consumer Code, the court of his municipality of residence or of domicile if located in Italian territory; in all other cases, the territorial jurisdiction is exclusively that of Modena, any other competent court excluded. *** Pursuant to Article 1341 of the Civil Code. the Customer declares to have read and specifically accept the following articles of these General Conditions: 6 (liability for delays in delivery), 10 (right to correct errors – exclusions of liability)
